Welcome to FamilyNest. These Terms of Use ("Terms") govern your access to and use of the FamilyNest mobile application ("App") and related services provided by FamilyNest ("we," "us," or "our").
By downloading, installing, or using FamilyNest, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. The subscription fee will be charged to your payment method on file.

We do not directly collect or store your payment information. All billing is handled by Apple or Google according to their respective terms and policies.

Upon cancellation, you will retain access to premium features until the end of your current billing period.

You retain ownership of all content (photos, videos, messages) you share through FamilyNest. By sharing content, you grant us a limited license to store, display, and transmit your content as necessary to provide the service.

We reserve the right to remove any content that violates these Terms without prior notice.
You agree to use FamilyNest only for lawful purposes and in accordance with these Terms. You agree NOT to:
The FamilyNest App, including its design, features, and content (excluding user-generated content), is owned by FamilyNest and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Your use of FamilyNest is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
FAMILYNEST IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILYNEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Our total liability shall not exceed the amount you paid for the subscription in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless FamilyNest and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:
You may terminate your account at any time by deleting your account through the App settings.
We may modify these Terms at any time. We will notify you of material changes by:
Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Yamhill County, Oregon.
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may proceed with formal dispute resolution.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamilyNest regarding your use of the App and supersede any prior agreements.
The following additional terms apply to users who download FamilyNest from the Apple App Store:
You and FamilyNest acknowledge that this Agreement is concluded between You and FamilyNest only, and not with Apple Inc. ("Apple"). FamilyNest, not Apple, is solely responsible for FamilyNest and the content thereof. This Agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
The license granted to you for FamilyNest is limited to a non-transferable license to use FamilyNest on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that FamilyNest may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
FamilyNest is solely responsible for providing any maintenance and support services with respect to FamilyNest, as specified in this Agreement or as required under applicable law. You and FamilyNest acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to FamilyNest.
FamilyNest is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of FamilyNest to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for FamilyNest to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to FamilyNest, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be FamilyNest's sole responsibility.
You and FamilyNest acknowledge that FamilyNest, not Apple, is responsible for addressing any claims by you or any third party relating to FamilyNest or your possession and/or use of FamilyNest, including, but not limited to: (i) product liability claims; (ii) any claim that FamilyNest fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You and FamilyNest acknowledge that, in the event of any third-party claim that FamilyNest or your possession and use of FamilyNest infringes that third party's intellectual property rights, FamilyNest, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using FamilyNest. For example, you must not be in violation of your wireless data service agreement when using FamilyNest.
You and FamilyNest acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
